It is the law in New Mexico that every vehicle operated on the road must be insured. Sadly this is often not the cases. We have all heard countless stories of drivers causing serious accidents who were not insured or accident victims who were involved in hit and run accidents where the at fault driver could not be identified. Even in cases where at fault driver had insurance it may not have been enough to cover all your damages. If this is the case you may be able to make a claim for damages under your own uninsured or underinsured coverage, meaning that your insurance company will compensate you for the damages you sustained up to the policy limited listed in your insurance policy. Of course the amount of compensation varies in every case and is dependent on the amount of damages sustained in the accident.

It is important to note that filing an uninsured claim with your own insurance company may make your insurance company’s interests adverse to your own. Therefore it is important that you consult with an attorney before accepting any settlement offer even if it is from your own insurance company.
